Be it enacted by the Legislature of Louisiana:
4 On page 1, delete lines 6 through 12, and insert the following:

(2)"Nondisclosureclause"meansaprovisioninacontractoragreement thatprohibits one ormorepartiestothecontractoragreement fromdisclosing conduct or information covered by the terms and conditions of the contract or agreement.

§2720.23.
Notwithstanding any provision of law tothecontrary,nothing in this Section shall be construed to prohibit a person, including a victim or alleged victim of sexual abuse against a minor, from entering into a contract or agreementthatrestrictsthedisclosure of information, including theamountor payment terms of a settlement, by another party to the contract or agreement, including an alleged perpetrator, provided that such restriction does not prevent disclosure protected pursuant to Subsection A of this Section.
Notwithstanding any provision of law to the contrary,nothing in this Section shall be construed to prohibit a person, including a victim or alleged Page 1 of 2 SCASB185 359 2040 victim of sexual abuse against a minor, from entering into a contract or agreementthatrestrictsthedisclosureofinformation,including theamount or payment terms of a settlement, by another party to the contract or agreement, including an alleged perpetrator, provided that such restriction does not prevent disclosure protected pursuant to Subsection A of this Section.
The provisions of this Act shall apply retroactively and prospectively to any nondisclosure clause in a contract or agreement entered into before, on, or after the effective date of this Act.
