SB 34 - AS INTRODUCED 25-0193 02/06 STATE OF NEW HAMPSHIRE In the Year of Our Lord Two Thousand Twenty Five AN ACT relative to parental consent for student participation in Medicaid to schools program.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Medicaid to Schools Program;
Amend RSA 186-C:25, VII and VIII to read as follows:
2IX. School Health Services;
ConsentThe ofprogram Parentshall terminate statewide if the federal government or Legalstate Guardianadopts Required.any policy contrary to a policy requiring parental control of all medical services provided to children.
AmendIf RSAa 200:27-alocal toschool readdistrict asadopts follows:such a contrary policy, the program shall terminate for that school only.
200:27-aAmend Consentthe ofbill Parentby orreplacing Legalsection Guardian3 Required.with the following:
A child's participation in any program that provides medical or dental treatment in any school setting shall require the explicit written consent of the child's parent or legal guardian for each new service as defined by a new diagnostic billing code.
This act shall take effect Januaryupon 1,its 2026.passage.
