LRB103 39207 CES 69355 b A BILL FOR SB3695 LRB103 39207 CES 69355 b AN ACT concerning health.
Be it enacted by the People of the State of Illinois, represented in the General Assembly:
Section 1.
Instead, it has made drug use less safe and has created an unregulated, underground market in which dosages are difficult to verify and dangerous adulterants, 10300SB3695sam001 -2- LRB103 39207 CES 71631 a such as fentanyl, are common.
(4) Harm reduction tools, including drug-checking kits, scales, and capsules, allow users to make safe and SB3695 - 2 - LRB103 39207 CES 69355 b more accurate, evidence-based decisions about their personal use of these substances, and allowing the use of such tools can increase public health and safety.
10300SB3695sam001 -3- LRB103 39207 CES 71631 a (8) Almost 20 countries around the world, including Portugal, the Czech Republic, and Spain, have expressly or effectively decriminalized the personal use of all substances.
(9) The City of Oakland, California, and the City of Santa Cruz, California have passed resolutions decriminalizing or deprioritizing the enforcement of laws SB3695 - 3 - LRB103 39207 CES 69355 b regulating the possession, use, and propagation of psychedelic plants and fungi.
(11) To transition away from criminalization models while protecting people who use or may use drugs and reduce negative environmental or cultural impacts, it is 10300SB3695sam001 -4- LRB103 39207 CES 71631 a necessary to review the full legal context in which these changes to the law are made.
(12) Criminalizing psychedelic plants and fungi has SB3695 - 4 - LRB103 39207 CES 69355 b denied people access to accurate education and harm reduction information related to the use of psychedelic compounds and limited the development of appropriate training for first responders and multi-responders, including law enforcement, emergency medical services, and fire services.
(15) These changes in law will not displace any restrictions on driving or operating a vehicle while impaired, an employer's ability to restrict the use of controlled substances by its employees, or the legal 10300SB3695sam001 -5- LRB103 39207 CES 71631 a standard for negligence.
(16) Peyote is specifically excluded from the list of substances to be decriminalized, including any cultivation, harvest, extraction, tincture, or other product manufactured or derived from it, because of the nearly endangered status of the peyote plant and the special significance peyote holds in Native American SB3695 - 5 - LRB103 39207 CES 69355 b spirituality.
(18) Research conducted by domestic and international medical institutions indicates that psilocybin is efficacious and safe for the treatment of a variety of mental health conditions, including, but not limited to, addiction, depression, anxiety disorders, headache 10300SB3695sam001 -6- LRB103 39207 CES 71631 a disorders, and end-of-life psychological distress.
and SB3695 - 6 - LRB103 39207 CES 69355 b (B) granted a "Breakthrough Therapy" designation for a treatment that uses psilocybin as a therapy for such depression.
and (B) adopt rules and regulations for the eventual implementation of a comprehensive regulatory framework that will allow persons 1821 years of age and older in this State to be provided psilocybin services.

(6) protecting the safety, welfare, health, and peace 10300SB3695sam001 -8- LRB103 39207 CES 71631 a of the people of this State by prioritizing this State's limited law enforcement resources in the most effective, consistent, and rational way;
